Re-Sealing of an Australian Probate

We were instructed by Solicitors from Sydney to apply for a re-sealing of the New South Wales Grant in the English Court to enable shareholdings registered in England to be transferred to the beneficiaries.

We obtained date of death valuations for the deceased’s shareholdings and prepared the Inheritance Tax return. After completing all the necessary formalities, the Grant was obtained and the Shareholdings transferred to the beneficiaries.

Landlord & Tenant issue for an Irish Resident

Our Irish client inherited a flat in London from his late mother and decided to privately rent it out. He had instructed managing agents to forward the rent to him. Unfortunately, the rent was not forthcoming and many letters and telephone calls made by him to his agents went unanswered.

We were instructed to bring proceedings against the agents and a judgment was soon obtained, requiring them to provide an account of the rent receipts from the property and pay our client the amount to which he was entitled.

Service of Papers for New Zealand Principals

Solicitors in New Zealand asked us to locate and serve proceedings on a former New Zealand resident known to be living in England. We arranged for a tracing agent to locate the individual using the information provided and a person fitting the profile was located in the south of England. Despite his denial that he was the defendant he was successfully served at his home address.

Acquisition of a commercial property for an Irish Resident

An Irish resident instructed us to act for him in the purchase of a valuable investment commercial property in the UK. We undertook all investigative aspects of the legal work and advised our client in relation to payment of Stamp Duty Land Tax and VAT.

We prepared a comprehensive report for our client. He was satisfied with the deal and we completed the acquisition on his behalf.

Personal Injury enquiry from Australia

Our professional clients in Australia needed assistance with obtaining evidence for use in a personal injury case. They were acting for the defendant’s insurer. The claimant was based in the UK, having been involved in a traffic accident in Sydney.

The New South Wales Court was to take evidence in the UK. We arranged for the claimant to be examined by local medical experts. Our clients were also prepared to invest in a surveillance report which we organised. We liaised with the Court Service to provide a courtroom and conference facilities at the Royal Courts of Justice where the case finally settled on the first day of the hearing.

Extracting an English Grant of Representation for an Irish Resident

We were instructed by Solicitors in Dublin to obtain an English Grant of Probate for a substantial estate where the deceased died domiciled and resident in Ireland. The estate was made up of UK shareholdings inherited from his late mother who died two years previously.

Due to the value of the estate, Inheritance Tax was payable. We obtained tax clearance from HM Revenue and Customs and obtained the Grant which enabled the shareholdings to be sold.
